PRIVACY POLICY OF AVEDIS ZILDJIAN CO.

Avedis Zildjian Co. (“Zildjian,” “our,” “us,” or “we”) is committed to protecting the privacy and security of the information of our website visitors and mobile app users (“you”). We want you to understand how we collect and use information from our websites located at zildjian.com and vicfirth.com (together, the “Sites”) and our related services (together with the Sites, the “Services”) so you can interact with us with confidence. By using the Services, you accept and agree to the practices this Privacy Policy describes. If you do not agree to any of the terms in this Privacy Policy, you should not use the Services.

WHAT INFORMATION DO WE COLLECT?

When you use our Services, we may collect, store, and process various kinds of data, including Personal Information about you. “Personal Information” refers to information about you that can be used to identify you, such as your name, address, telephone number, e‑mail address, payment card information, account credentials, IP address, device identifiers, or transaction information.

Specifically, we may collect, store, or process information when you:

  • Register for an account on either of the Sites;
  • Place an order, initiate a return, or make an exchange;
  • Submit a form on either of the Sites;
  • Contact us with inquiries, including via email or through customer service forms;
  • Subscribe to our newsletters or otherwise sign up to receive communications;
  • Respond to a survey;
  • Enter contests, sweepstakes, or promotions; or
  • Voluntarily provide information to us in other ways.

We may also collect details of your visits to the Sites and the pages you access, including, but not limited to, traffic data, location data, weblogs, communication data, your IP address, browser type, device and operating system information, the date and time you accessed or left the Sites, and which pages and features you viewed. Some parts of the Sites use cookies and similar technologies to collect this information about your general internet usage. The above excludes text messaging originator opt‑in data and consent; we do not share this information with any unaffiliated or non‑agent third parties.

WHY WE COLLECT INFORMATION

We use your information for the following purposes:

  • To present our Services to you and operate, maintain, and improve the Sites;
  • To process and fulfill orders, returns, exchanges, and payments, and to provide related customer service;
  • To personalize your experience on the Sites and tailor content and offers;
  • To provide you with information, products, or services that you request from us;

  • To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, in which Personal Information held by us about our Site users is among the assets transferred. 

HOW WE USE COOKIES AND SIMILAR TECHNOLOGIES

We use cookies (small text files stored in your browser) and other techniques such as web beacons and pixels (small, clear picture files used to track your online activities) (“Tracking Technologies”). Tracking Technologies collect information that tells us how you use our Sites and Services, which helps us make the Services relevant to your interests and needs. We use a number of different types of cookies, including functional, performance/analytics, advertising, and social media/content cookies.

  • Marketing Communications. You may opt out of marketing emails by using the “unsubscribe” link in those emails. This opt‑out does not apply to transactional communications (e.g., order confirmations, shipping updates, or service notices).
  • SMS/Messaging. If you have opted to receive SMS or similar messages, you may stop receiving them by following the opt‑out instructions included in those messages.

"DO NOT TRACK" REQUESTS

Our Sites currently do not respond to “Do Not Track” or similar signals.

HOW WE SHARE YOUR PERSONAL INFORMATION

We may disclose your Personal Information as follows:

  • With our affiliates, contractors, vendors, processors, and service providers we use to support our business and/or our Services (for example, for order fulfillment, payments, shipping, analytics, customer support, marketing, and security);
  • For any other purpose disclosed by us when you provide the information;
  • With social media companies and platforms, consistent with your choices and our cookie and pixel implementations;
  • With third parties for interest‑based advertising and data analytics;
  • With your consent or at your direction, including if you provide Personal Information as part of a contest;
  • With affiliates if you opt in to receiving communications from affiliates;
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, in which Personal Information held by us about the Sites’ users is among the assets transferred;
  • To enforce any agreement, including any applicable terms of service; to establish or exercise our rights; and to defend against legal claims; and
  • To law enforcement and other government authorities if we reasonably believe such action is necessary to comply with law or legal process, protect the security or integrity of our systems, or protect our rights, privacy, safety, or property, or that of our affiliates, customers, or others. 

Certain areas Sites may enable you to access online forums where you can post messages and read messages posted by other users (the “Forums”).  If you share Personal Information in the Forums, others will be able to view and have access to that information. Please exercise caution when sharing any information on the Forums.  We are not liable for any misuse of the Personal Information you share on the Forums. We can correct or delete any information you have posted on a blog, if you so request, by emailing detail to zcustomercare@zildjian.com.

PAYMENT INFORMATION

When you make a purchase on the Sites, you may be redirected to, or your payment may be processed by, one or more of our third‑party payment service providers and/or e‑commerce platform providers. These providers may collect or have access to your name, billing address, shipping address, email address, payment amount, and payment card or other payment information to process your transaction. Please review the applicable provider’s privacy policy for information on how they protect your information. 

HOW WE PROTECT YOUR INFORMATION

To protect your Personal Information, we take commercially reasonable precautions and follow industry best practices designed to prevent it from being inappropriately lost, misused, accessed, disclosed, altered, or destroyed. However, no data security measures are entirely infallible. As a result, while we strive to protect your Personal Information, we cannot guarantee its absolute security. Your transmission of information to our Services is at your own risk. 

THIRD-PARTY WEBSITES AND SOCIAL MEDIA

The Sites may contain links to other sites, including those of third parties or partners. While we seek to link only to sites that share our high standards and respect for privacy, we are not responsible for the privacy practices of other websites. By accessing third‑party websites or applications through the Sites, you are consenting to the terms and privacy policies of those websites. Our Sites may include social media features and widgets that may set cookies to function properly and may collect Personal Information such as your IP address. These features are governed by the privacy policies of the social media platforms.

INTERNATIONAL VISITORS

Our Sites are hosted and operated in the United States. By using the Sites, you are consenting to the transfer of your Personal Information to the United States. If you are accessing the Sites from outside the United States, please be advised that U.S. law may not offer the same level of privacy protection as the law of your jurisdiction. 

CALIFORNIA VISITORS

This California Privacy Notice supplements the information contained in our Privacy Policy and applies solely to California consumers as defined in the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (collectively, “CCPA”). Terms defined in the CCPA have the same meaning when used in this section.

In the 12 months preceding the effective date of this Notice, we may have collected the following categories of Personal Information: identifiers (e.g., name, email address, postal address, phone number, IP address, device identifiers, account credentials); customer records (e.g., billing and shipping addresses); commercial information (e.g., products purchased or considered); internet or other electronic network activity information (e.g., browsing history, interactions with the Sites and ads); geolocation data (approximate); inferences drawn from the information we collect; and, where you choose to provide it, user‑generated content (e.g., reviews) and audio/visual content (e.g., customer service recordings).
  2. Sensitive Personal Information We Collect. We do not collect Sensitive Personal Information.
  3. Sources of Personal Information. We collect Personal Information directly from you, automatically from your device and browser when you interact with the Sites, and from service providers and third parties (e.g., analytics, advertising partners, payment providers, and fulfillment partners).
  4. Purposes for Collection and Use. We collect, use, and disclose Personal Information for the business and commercial purposes described in “Why We Collect Information” above.
  5. Disclosure of Personal Information. We disclose Personal Information to service providers and contractors for business purposes such as order fulfillment, payment processing, analytics, marketing, security, and customer support. We may also disclose Personal Information to third parties as described in “How We Share Your Personal Information.”
  6. “Sale” or “Sharing” of Personal Information. We do not exchange Personal Information for money. However, our use of third‑party advertising cookies and similar technologies may be considered a “sale” or “sharing” of Personal Information under the CCPA. In the preceding 12 months, we may have “sold” or “shared” identifiers, internet or other electronic network activity information, and inferences to advertising and analytics partners to provide more relevant advertising and to measure campaign performance. You may opt out of “sale” or “sharing” by using the cookie preferences on our Sites and by following the instructions in “Your Choices About Cookies, Analytics, and Advertising.” You may also submit a request via the methods listed under “Exercising Your California Privacy Rights.”
  7. Retention. We retain Personal Information for as long as reasonably necessary to achieve the purposes disclosed in this Policy or as required by law, including to meet legal, tax, accounting, or reporting requirements, resolve disputes, and enforce our agreements.
  8. Your California Privacy Rights. Subject to certain exceptions, California residents have the right to:
    1. Know and access the categories and specific pieces of Personal Information we have collected about you, the categories of sources, purposes, and third parties with whom we disclose Personal Information;
    2. Delete Personal Information we collected from you;
    3. Correct inaccurate Personal Information;
    4. Opt out of the sale or sharing of Personal Information;
    5. Limit the use and disclosure of sensitive Personal Information (to the extent we collect it for purposes not exempt under the CCPA); and
    6. Be free from unlawful discrimination for exercising your rights.
  9. Exercising Your California Privacy Rights. You may submit a verifiable consumer request to know, access, delete, or correct your Personal Information by contacting us as described under “Contacting Us.” We will verify your request by using information we already have about you (for example, matching identifying information, order details, or account information). You may designate an authorized agent to make a request on your behalf, subject to verification of the agent’s authorization and your identity. If we deny your request, you may appeal by following the instructions in our response.
  10. Notice of Financial Incentives. If we offer a program that provides a price or service difference, such as a discount for subscribing to our marketing emails, we will describe the material terms of the program at the time of signup, including how to opt in and how to withdraw, and we will explain how the incentive is reasonably related to the value of your Personal Information.
  11. Shine the Light Law.  California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We process Personal Information where: (i) you have given consent; (ii) it is necessary to perform a contract with you (e.g., to provide Services, fulfill an order); (iii) it is necessary for our legitimate interests (e.g., to ensure network and information security, to market and promote our Services, to improve and develop the Sites), provided that such interests are not overridden by your interests or fundamental rights and freedoms; or (iv) it is necessary to comply with a legal obligation. We may also process Personal Information to protect your vital interests or those of another person.
  • Your GDPR Rights. Subject to applicable law, you have the right to: (1) be informed about our processing activities; (2) access your Personal Information; (3) rectify inaccurate Personal Information; (4) erase your Personal Information in certain circumstances; (5) restrict processing; (6) data portability; (7) object to processing, including to direct marketing; and (8) not be subject to decisions based solely on automated processing, including profiling, where such decisions produce legal or similarly significant effects.   • International Transfers. If we transfer your Personal Information outside of your jurisdiction, we will implement appropriate safeguards, such as standard contractual clauses approved by the European Commission or other lawful transfer mechanisms.
  • Retention. We retain Personal Information as described in “Retention” above.
  • Complaints. You may lodge a complaint with your local data protection authority. We would appreciate the opportunity to address your concerns first by contacting us directly. 

USERS ONLY OF LEGAL AGE OF MAJORITY

Our Services are not intended for children under 13 years of age, and we do not knowingly collect Personal Information from children under 13. If you are under 13, do not use or provide any information on the Services or provide any information about yourself to us, including your name, address, telephone number, e‑mail address, or any username you may use. If we learn we have collected Personal Information from a child under 13 without verifiable parental consent, we will delete that information. For users in the EEA, UK, or Switzerland, we do not knowingly collect Personal Information from children under the age at which consent is valid under applicable law without verifiable parental consent.

REVIEW, CORRECT, AND DELETE OF YOUR INFORMATION

You may request to review, edit, and/or delete the information we collected about you at any time by contacting us as described below. If your information has been shared with a third party as described in this Privacy Policy, that third party has received its own copy of your data. If you have been contacted by one of these third parties and wish to correct or delete your information, please contact them directly.

RETENTION

We will retain your Personal Information for as long as needed to fulfill the purposes for which we collected it, including to satisfy any legal, accounting, or reporting requirements, or as otherwise permitted by law. When determining the appropriate retention period, we consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process it, and whether we can achieve those purposes through other means.

PRIVACY POLICY UPDATES

We may update this Privacy Policy from time to time, so please review it regularly. If we materially change our Privacy Policy, we will notify you by contacting you through your provided e‑mail address and/or by posting a notice on the Sites. Your continued use of the Sites after we make changes is deemed acceptance of those changes.
